Section 39A
Pension and gratuity of missing employees
(1) If an employee who worked in the civil service goes missing and is not found alive for the specified period, the amount of gratuity or pension received by such an employee under section 36 or 37 shall be given to his family.
(2) Notwithstanding anything written in sub-section (1), in accordance with section 37, if a person entitled to receive pension disappears before receiving pension, up to seven years and if he disappears after starting to receive pension, the entire amount of pension to his family and after that period to his spouse for life. Half of the pension will be given as family pension.
(3) If the missing employee is found later, if the gratuity under section 36 has not been paid, the amount of the gratuity or the pension amount to be received under section 37 will be given to him from the date he came to claim it. However, a person who is found later shall not be entitled to claim the amount of gratuity, pension or family pension that has been paid in accordance with sub-section (1) or (2).
